Children’s compensation and turning 18

Assuming that your child is a minor when the claim is made, your child’s compensation would be protected by the court until your child turns 18 years old.

Should there be certain things to be paid for, such as care, assistance, or changes to your house to aid your child (e.g. ramps), then your solicitor can help you set up a trust where you may be able to access some of the compensation sooner in the interests of the child’s recovery and day-to-day activities.

Compensation will be released to the child on their 18th birthday, so long as they have mental capacity to receive it. Otherwise, the Court of Protection will appoint a deputy who will be responsible for the money, ensuring it is handled in the child’s best interests.
