Asbestosis

Asbestosis is a lung condition that causes breathing problems and can make it difficult for sufferers to maintain an active lifestyle or manual job once it has developed.

It is an incurable disease and the symptoms can take a long time to develop. However those symptoms can have a lasting effect on your breathing, your ability to go to work, and look after yourself and your family.

Claim Today has been a personal injury brand specialising in workplace and industrial accidents, including asbestosis and mesothelioma, for over 20 years and we have the experience and expertise to get you the personal injury compensation and support you need to look ahead to the future.

What is asbestosis?

Asbestosis is caused by exposure to disturbed asbestos. The fibres in asbestos dust are extremely dangerous as they can stick to the lungs. It is this that causes asbestosis.

Asbestos was used in most construction work from the 1930s until the mid 1970s as it was a strong and heat resistant material. However upon learning about the side effects of asbestos dust, it is now highly regulated in how it is used.

Symptoms

The main symptoms of asbestosis are:

  • shortness of breath
  • tightness or sharp pains in the chest
  • coughing or wheezing
  • extreme tiredness

A related illness to asbestosis is mesothelioma, a type of cancer that affects the lungs and acts a lot like asbestosis in terms of its symptoms.

Claiming against your workplace

If you believe that your asbestosis or related illnesses such as mesothelioma have been caused by adverse working conditions, it could be considered an ‘occupational lung disease’ which we may be able to make a personal injury claim on your behalf.

As asbestosis is something that can develop slowly, it may be the case that you may not be working for the company anymore, or that the company no longer exists. In these cases, you may still be able to make a claim. The claim could be made against the insurance company that covered the company at the time, or through the Pneumoconiosis (Workman’s Compensation) Act 1979 in some instances.

I don’t want to jeopardise my job my claiming…

Quite simply, you wouldn’t be putting your job at risk by claiming against your employer.

In the UK, there are strict employment laws in place stating that employers can not treat you any differently or dismiss you for bringing a claim against them.

In fact, all UK businesses are required to have employer’s liability insurance, which is likely to be what employer’s would use to handle your claim, safeguarding themselves in the event of a claim.

Do I have a claim?

If you were injured in a workplace incident and you believe that it falls under employer liability, then you might have a claim.

It is important to have as many details about the accident to hand as possible. This includes when and where the incident took place, details of those involved, and of any witnesses if you have any (including details of any CCTV that may be available).

We offer free impartial advice on whether you can make a claim either by completing our online form, or calling our claim team on 0800 29 800 29. Alternatively, request a callback on this page and we will call you back.

Serious injuries are best identified by how long they’ve needed treatment for, if you are unable to return to work and how long you are unable to return to work, as well as if you need assistance in completing day-to-day tasks.

If your injury has impacted your life in a way that has set you back financially or it will do so in the future, then it is likely to be serious enough to enquire about making a claim.

The main things that you might be able to claim against are:

  • loss of earnings, as well as potential future earnings if your future progression has been impacted as a result of the injury; and
  • the loss of being able to participate in activities such as sport or learning particular skills that you are now unable to due to your injury.

We do receive claim enquiries from people who are calling on behalf of somebody else, mainly parents on behalf of children, or spouses on behalf of their partners – particularly in cases of more serious injuries including comas and brain injuries.

You can certainly start the process on someone else’s behalf, and we will guide you through the steps needed to ensure that it is as simple as possible through this difficult time. You can start by using our online form, requesting a callback, or by calling us on 0800 29 800 29.
