Busting the Myths about Claiming for Compensation

Myth 1 : I will have to pay to claim

What is no win no fee and how does it work?

No Win No Fee means if you don’t win your no win no fee claim, you pay nothing to anyone – it’s as simple as that.

What if I win my no win no fee claim

If you win your claim, your solicitor will typically make the following deductions from the compensation you are awarded:

–      A ‘success fee usually 25% but can vary depending on type of injury

–      cost of the premium for legal insurance you may have needed to ensure your claim is risk free.

–      You keep the rest and this will always be the majority of the compensation awarded to you

Claim Today will explain all this in detail at the start so you know what to expect if your claim succeeds.

If you don’t win your no win no fee claim, you pay nothing. It’s as simple as that.

Myth 2 It’s somehow not Right to Claim!

Many people have been given the impression its wrong to claim compensation or somehow not “proper” by a long running campaign in the press by the Insurance Industry: they simply wish to put people off from claiming so they can make millions pounds more in profit each year!

New research has highlighted a range of common myths that are skewing the nation’s understanding of compensation and restricting access to claiming for injury as a result.

A YouGov study uncovered a number of reasons why almost a third of people in Britain would be reluctant to make a claim for compensation after an accident that wasn’t their fault – even though the overwhelming majority (85%) felt it would be fair for others to do so.

The research showed that too many people would decide not to make a claim because of falsehoods that are fueled by the so-called ‘compensation culture’, there is no such thing!

People are now making less claims than they ever did due to the successful campaign by Insurance companies to “put people off”

The Law Gazette in March 2020 reported:

The number of personal injury claims made in England and Wales has fallen to its lowest level since 2011, new figures have confirmed.

Civil justice statistics published last week by the Ministry of Justice show that just under 27,000 PI claims were issued in the final three months of 2019 – down 5% on the previous quarter

Personal injury claims fall again to eight-year low in 2020 and since the Pandemic will have fallen even further

There is no compensation culture. In fact the reverse, the Insurance companies have been so effective with their campaigns to restrict access to justice and give the impression its wrong to claim – many ordinary working people are failing to claim their legal entitlement to compensation.

Myth 4: People who claim are just after free money

There’s a common belief that the UK has a ‘claims culture’, which brings with it the idea that people who make a claim just want an easy way to make money.

This is untrue and can make people with genuine injuries feel unfairly guilty about making a compensation claim and pursuing their legal right.

Compensation is simply there to help people who’ve had an accident that wasn’t their fault to get back to where they were before. It can be very helpful to those suffering from the financial, physical and emotional consequences of an accident or negligence, and can help cover costs of bills, lost savings, treatment, care and medical equipment.

Claiming compensation is the right of all people of all ages backgrounds and social status – don’t let anyone put you off if you don’t claim it’s simply more profits for the Insurance industry

Myth 5: I’ll lose my job if I claim against my employer

A common worry about making a claim for an accident at work is that doing so could put the claimant’s job at risk.

This is simply not true, as it is illegal for an employer to let someone go because of a claim.

There are strict rules and laws around dismissal and it’s against the law for a claimant to be fired or treated any differently for making a claim.

If they were to be fired, this would be considered ‘unfair dismissal’ and legal action could be taken against the employer
